Open Question: I own investment property. What are my liabilities if the property is foreclosed?

I live in an area where I cannot afford to purchase a decent home or even a condo without really stretching my budget. However, I spend most of my weekends in a resort destination about 3 hours away from my office. There, I could afford a nice cheap property. Ideally, I'd like to have homes in both locations someday anyways. So rather than continue to be only a renter, I was thinking it would make a lot of sense to purchase a place there, and rent a cheap apartment near my work. My lifestyle would allow this (no kids etc), and I make enough money to afford the mortgage and rent (and still qualify for a loan). BUT...I was told by a real estate agent that it is very unlikely that I would GET such a loan, even with the income, credit rating and down payment. She said that lenders don't give first time homebuyers loans except for a primary residence, and a home 3 hours away where I didn't spend at least 51% of my time would never qualify as a primary residence. Is this true?? It seems silly that the bank would endorse the opposite strategy with ease (buy locally and rent remote) but I could never afford it, and yet I could afford it my way and can't get the money. Anyone have any insight? Thanks!

also have little or no credit history, not a lot of money saved either, so the loan is under his name.

Basically 99% of the down payment is from my husband however i will be contributing cash towards the down payment and we'll both be paying over 1/2 our wages towards the monthly mortgage payments.

Im really worried as we recieved the proposed lease today to review and my name appeared nowhere only my husbands name was on this document.

Im new to this we're both young and first time buyers.
What contract should i request my name to be on?
A friend of mine advised me to make sure Im on some form of documentation, which one I dont know?

We both discussed this, my husband said the mortgage lender said i couldnt be on anything because of above senario.

I love my husband dearly, we're both very honest and open with each other, I just dont want to feel like a renter, he's looking into this tomorrow with the lawyer.

Does anyone else have advise, what do one income families do when it comes to legal documents regarding an apartment.
Should I be on the title or a tenant in common, what is what, is there anything else!!

I know my credit score will be destroyed. What about costs, fees, penalties, fines? Am I still responsible for taxes owed on the property (due in October and December)? Do my 1st and 2nd mortgages disappear? Or will I still have to pay the mortgagors any monies?

Open Question: I owned a home and my wife owned a home before we were married. ?

here in Los Angeles. very nicely furnished, 2 bed, 3 bath, plus garage townhouse for $1100 / month (~100 for util).

question: Are these actions normal from my potential landlord?
(A) He wants me to move in 2 weeks. I can only move in until 4. he says lets compromise and make it 3. but that'd mean i'd be paying a week's salary for *both* my current place and their place! I told him this, but he said it's b/c of their mortgage and doesn't want to lose out on the "rental time." (e.g. a week goes by without cash coming in).
(B) Since it's their townhouse, he and his fiancee reserve the right to crash the house. Ok no problem with that. however, when I ask him to at least tell me *when* they will visit, he remarks, "Well, it's our house. Why should we give you a head's up?"

Does this sound fishy? sounds too good to be true for me, and i want to e-mail and withdraw. haven't paid or signed anything, so hopefully that's ok too?

THANKS FOR YOUR ADVICE!!!H i think your (my) intuition is correct.It sounded too good to be true. The apartment was fully furnished without any clothes removed. Seems kinda sad they were going to trick me, since her husband used to work at the university i now teach at.

Resolved Question: Does this sound odd to you?


A potential landlord (with an awesome rental) answered the following to my questions:

(A) "I don't see why I have to call ahead of time if I want to visit. It's still my townhouse, although you are just privately renting one room." (note they are not in the state 90% of the time).
(B) The later you move in, the less $$$ i get from paying the mortgage ...so please understand if I ask you to move in a week before the end date of your other contract. (so for a week i have to pay rent at two places).

Does this sound fishy to you?

Some people hope to catch a glimpse of someone famous coming out of these stores. On the other hand, there are some people who don’t understand why someone would want to move or live in Los Angeles. Los Angeles is seen as an over-populated city where natural disasters like earthquakes and wildfires happen frequently. Like many other cities, Los Angeles has its advantages and disadvantages that people enjoy like the wonderful weather, diversity, and job opportunities.

Living in Los Angeles offers diversity in people, cultures and food. There are all kinds of different ethnicities from around the world that live in Los Angeles. Therefore, there are many different kinds of restaurants that people can choose from. These restaurants can range from P.F. Chang’s to Roscoe’s House of Chicken’n Waffles to In-N-Out Burgers. There are also many places where people can go to like, Chinatown, Thai Town, and Little Tokyo. This kind of diversity makes living in Los Angeles a great way to experience different cultures. For example, people can at a workplace where there are many employees of different ethnicities and there is a language barrier, so they communicate with each other in different languages besides English. Los Angeles also offers a taste of the different cultures living in this diverse city.

There are many job opportunities for people who live in Los Angeles as well. People can work in the Los Angeles County or work for the City. Jobs like clerks, architect, and engineering pay higher salaries with benefits. Los Angeles also offers a variety of jobs in the film and television industry. Therefore, people live and move to L.A. because they are aspire to fulfill their dreams of becoming actors, actresses or broadcasters in Hollywood or Burbank where Walt Disney, Warner Brothers, CNN, and Paramount Studios are located. There are also many shopping centers like malls and outlets around Los Angeles where retail jobs are available. This makes L.A. a good place not only for students to work and go to school at the same time, but also for people who are looking for part-time job or full-time job.

Another advantage of living in Los Angeles is the great weather. People like living in Los Angeles because they can go to the beach and the mountains year round. During the winter it does not get too cold, with temperatures dropping down to about 40 degrees at night and sometimes 80 degrees during the day. For example, people can go to Snow Summit at Big Bear Mountain to play in the snow, go snowboarding or skiing and the next day they can go to the beach. During the summer time it can get pretty hot with temperatures in the mid 90’s to the low 100’s. For example, people can go outside to the beach, go to a park to have a picnic or go to water parks like Raging Waters and Hurricane Harbor. Although, due to Los Angeles lack of rain, there are fire-warning alerts throughout the hottest time of the year. The fires can occur along hillsides, mountains, and very dry brush areas where the heat of the sun or a cigarette can ignite a wildfire.

Although, one can find oneself getting around L.A. is not always easy. Traffic in and around the city can be a disadvantage. The freeways do not always move as smoothly as they can. Rush hour traffic can be daunting and frustrating especially if one had to drive through it. Los Angeles is home to some of the busiest freeways in the country. With gas prices rising and with no end in sight, people are finding different ways to get from point A to point B. For instance, people are trying to carpool or ride the bus or the Metro in order to get to work and around the city. Some families only drive their cars on the weekends to go on family outings.

Another disadvantage of living in Los Angeles is the cost of living. Many people cannot afford to buy a home because the rising housing market prices. For example, a house with 3 bedrooms and 2 bathrooms can be very expensive depending on the area. This is why many people cannot afford to buy a house at this time. If they cannot afford to pay for it, the bank takes it back. This is the reason why there are a lot of foreclosed homes because homeowners are not able to pay their mortgage. Rent is also on the rise in L.A. An apartment can rent for a few thousand dollars monthly for a 2 bedroom and 1 bath apartment. Therefore, it is really hard for people to maintain a comfortable living in Los Angeles with the rising cost of living.

Finally, the crime rate in Los Angeles is also pretty high. This is true of many cities but Los Angeles is home to many gangs. Gang violence and homicides happen at an alarming rate and unfortunately innocent people are killed because rival gang members shoot at each other. It is not only homicides that occur, but also robbery that happen everyday in the Los Angeles area.

Despite all the disadvantages, I continue living in Los Angeles. I like being a part of the melting pot that Los Angeles has to offer. I like having friends of different ethnicities as we go out to different restaurants because I get to taste different foods and learn more about their cultures. I also love the summer weather in Los Angeles because I can go to the beach to play some beach volleyball. Although, I do get frustrated with running into traffic, the cost of living and the crime rate. It helps that I have a strong bond with my family and friends around the Los Angeles area.

Open Question: When a bus time table gets changed often and regularly is it a symptom of:?

A. the government can not do their job properly in providing a decent service to constituants.
B. the bus company regards passengers as an inconvenience as fuel prices rise and dont really want them to place two three hour waits during the day.
C. the bus drivers can not tollerate the abuse from management in the bus company demanding higher wages for their mortgage stress and own rising fuel prices.
D. it is easier to not drive to work on buses because they were designed for kids and not reducing green house gas emissions or reducing road traffic density.
E. We like grid lock bus car parks the world over so let the pessants drive on per car and really foul up the air.
F. The country has gone to the dogs, buses do a better job of smashing up the road edge than garbage trucks so council dont have to make better roads.
G. God Only knows.

The contractor will not pick up or return calls. I've even called her and she put him on the phone only to guarantee work completion that week... with no call, no show, again. The contractor has lied to her repeatedly about work completion, requiring permits (which I've looked into), etc. I have emails to and from her confirming this correspondence with apologies. There is only a verbal agreement with no written contract. I've paid 1/2 the loot up front. I'm really trying not to get old school about this. We're going on a year and winter's almost here... I would really appreciate any help!

I have both of their numbers and can only contact the broker. The contractor will not pick up or return calls. I've even called her and she put him on the phone only to guarantee work completion that week... with no call, no show, again. Open Question: UK Law - Last will and testament?


Would appreciate a professional opinion and ideally someone who is working / au fait with UK law.
My Mother passed away recently leaving her assets to be divided equally between her 3 children.. my brother and sister were made executors of the will as I live in NZ. In brief her assets are essentially a reasonable sum of money and an apartment with no mortgage.
Question: Is it possible to execute the will in 2 parts i.e. aportion the liquid cash equally between the three of us now and then sort out the remaining finance once the apartment has been sold? My sister is getting married in UK ealry next year and I am keen to take my whole family over for the wedding and the money due to me via my Mothers will would make that possible.. again would prefer a legal opinion on this only

Open Question: How do I sort out this???

My partner wants me to have my pay check deposited into his mortgage for six months before he will put my name on the mortgage, i am not too comfortable with this idea. He says that he has more to loose (half a house) than i have, (my pay) therefore i should prove that i can do it before he puts my name on to the mortgage. We are not married and have only been living together for a few months.
Am I over reacting with my concerns, or should i be worried by his actions?

Open Question: Property Valuation for Lifetime Mortgage ?


Almost 6 months ago I applied to Prudential for a Lifetime Mortgage. A valuation took place, an offer made and accepted by me on the basis of that valuation.
There have been protracted technical queries over precise descriptions of the property and my purchase of the freehold, which have taken so much time.
A fortnight ago I was given a funds would be released date of mid August, then when that was overdue the lender's solicitors demanded a fresh Land Registry search. All is now sorted out but the insurers' solicitors will not give a date to release the funds to me.
As the valuation is almost 6 months old and of course the house has dropped in value during that time, I wonder whether that valuation might be due to expire and the insurers are dragging their feet over this hoping to demand a fresh valuation? Can anyone advise whether they have a right to do this please?

I bought my WI home in summer '05, I've heard others can deduct interest paid, but when we got the statement from our mortgage co. that box was empty. Is there any way around this?

Open Question: Can we move a mobile home onto this property?

Ok, I'm in the UK and I' m sure everyone knows about the credit crunch by now. I wanted to invest in property but it's proving VERY difficult to find a mortgage right now so I'm almost giving up. I have tried to look for buy to let mortgages but that means the property would have to be worth about £100 000 which is ok, but the rental figures are not stacking up since the interest rates are so high.
So I am stuck with £20K in my bank account and only will power is stopping me from going shopping.
I have tried to look at overseas property but I'm not sure if buying in Cyprus or the US is the way to go. Florida right now looks good with prices having fallen by almost 50% on some developments, but I am still unsure what I would get back. I cannot lose the capital.

I recently saw something in the paper about investing in Oil, does anyone know more about it? Would I lose my money? Is it high risk?

What other ideas? thanks in advance.

Open Question: Buying 1st Home and Private Mortgage Insurance (PMI)?


Question... I'm purchasing a home from a family member and do not have 20% to put down. Since i'm purchasing this home under the value of the home (basically i'm getting a discount from family) is there anyway to use the difference between the value of the house and the sell price as the 20% down? Basically like there was equity built into the home with the discount.

I'm sorry if i'm not making too much sense. Hope someone can answer my question. Besides the obvious "contact your lender for the answer"

Open Question: Can we move a mobile home onto this property?


My parents have a very large lot with their home, and have offered that we could move a trailer onto the property if we end up selling our house, which is currently on the market. We are interested in the idea, but are wondering if we are allowed to do this. Where they live does not have zoning and allows trailers, however we didn't know about the legality of hooking our trailer up to the systems of their house - you know water, sewer, electric. We don't want to have a seperate sewer drilled or anything, because this will be temporary until we find another place to buy. How does something like this work? Also, they still pay a mortgage, and I'm not sure if that matters at all either. Any help would be appreciated!

Open Question: How can I get my ex-fiance to refinance?


Ugh, I am so frustrated!! My ex-fiance and I split 2 years ago. We had a home together with both of our names on the loan and title. When we split we agreed not to sell because he was going to live there and refinance within a few months. Well, it then turned into 6 months, a year, and now going on two years.
He has so many excuses as to why he won't do it. His main one is that he will not take anything less than the rate he has now (a good rate due to first time homebuyers and goverment assistance). He makes a very good amount of money where both he and his wife work, but he is just stubborn beyond belief.
We have both married since then and I have been trying since day one to get him to get in gear.
So, basically he has recently told me that he isn't going to do anything anytime soon. I am in so much debt on my own right now that all I can think of is bankruptcy. I've tried for 2 years to get a consolidation loan and all the companies have told me I can't aquire one due to the mortgage partly in my name. I just want to scream!!! Any advice out there?!

Open Question: Easy Police Departments to join?


I want to become a police officer, but my credit sucks right now. I just got foreclosed on. Are there any police departments that don't worry so much about officer's credit rating, or am I screwed for now?

I have held the same job for over 5 years. I have never done illegal drugs. I have no criminal record.

I had great credit for years, I just have fallen on hard financial times. My wife got a sick and couldn't work, plus her mounting medical bills, we couldn't afford our mortgage anymore.

Adam is 42 and works in an office. He’s been trying for promotion for several years without success. His wife is expecting their third child and he really needs the money a promotion would bring, more than ever. Things are so bad financially, that Adam is behind with the mortgage, which is causing a massive strain on his marriage and worry to his pregnant wife The promotion would see a large increase in salary and would end his money worries.

There’s a new Director (male) at the company and as an ice-breaker, the whole department is having an away day at a local hotel. There’s a free bar.

During the evening, Adam is talking to the new director, who having seen Adam’s career history (and rugged good looks!) thinks he is worthy of the promotion.

The dastardly new director promises Adam that he can get his promotion if he just does him one small (sexual) favour.

Open Question: Through what company can I write reverse mortgages?


I am an independent life and annuity salesperson looking for a reverse mortgage lender who will allow me to work from my home office, and offer such a product to my current clients as well as perhaps following up on their current leads, too. I am NOT mortgage licensed (though I have 10 years of experience in mortgage lending) and live in Pennsylvania.

Open Question: Does it matter if your down payment is "gifted" from a family member?

I met a woman at the start of the year, we had both just been dumped, so we decided just to be friends and see where things go, there are logistical problems with dating or going much further at present, but they can be over come. I've been talked into being checked for STD's, been introduced to her parents, been moaned at for not calling her every day, she complains I work weekends so can't visit as often as shewould like, but at the same time have been banned from staying over night so her children don't get the wrong idea. she plans for a joint future, when I take you to x place, we could afford a mortgage on that etc. I've been told she is on the pill and been given suggestive talks on what to do with strawberries , cream and champagne, she doesn't worry about wandering around in just a towel in front of me or asking me to wash her back when she is taking a bath. Yet when I talked about changing my shifts so we could see more of each other I was told it won't work I don't have feelings for you. Given the above I disagree.

Open Question: Question for first time buyers?


Are there any of you out there that have got a mortgage approved in the last 3 months or so?

Did you have to have a massive deposit? If you did, how did you get this (saving up, borrowing from family etc).

Are there other of you who haven't even applied because you think you won't get one?

Just wondering what's going on as this determines how/when the god-awful housing market will start to change. Kemperk - it's almost normal is it?

Is that why myself and numerous other people I know have had our significantly reduced homes on the market for months and months with NO INTEREST WHATSOEVER?

The number of houses going through this year as compared to last has reduced to 17% of what it was. I don't think that's almost normal. There are no buyers because nobody can get a mortgage unless they have a massive deposit.

Open Question: i've applied with mortgage lenders and still can't a loan with a past bankruptcy.what can i do?

We are just now looking into mortgages and they asked if our down payment was a gift, which it is, I am wondering how this changes things if the money actually came from us? (first time home buyers)

Open Question: Can mom be cosigner for home loan?

Ive just thought!!!!!!!

Im from the UK planning a move to hawaii in the future, BUT surely if i get a permanant visa, i still wont be able to buy a house?
Wouldnt i need a credit rating as surely my UK credit rating wouldnt count? and would they lend money to someone who had only just moved there?

BUT i am a nurse, so being as i know the country is in need of nurses, would a bank be willing to lend me the money and get a mortgage just for this reason?

I am confused!!!!!!!!

Open Question: Can mom be cosigner for home loan?


My husband and I are living in an apartment right now and are thinking of starting a family in a few years so we want to buy a condo. I do not work at the moment. My husband has only been at his job for 3 months. We make more then enough money to pay for everything because his job demands over time. Hes only 20 and has great credit but we talked to a lender and they said since he hasn't been at his job for a year they wont count all his over time. So I don't know if he will qualify for the loan himself because of our debt to income ratio even though the mortgage payment would be less then rent is right now.

I wanted to know if his mom could cosign with him even if she is not living there. She has goodish credit but I don't know about her debt to income ratio.

All this is new to us so I don't really understand any of it. Any help would be wonderful! Thank you! :-) My husband and his mom are really close. And we are a tight family. We trust each other and are open about of finances. Shes helped up cosign for our cars and such before. And if we cant make a payment she wont mind helping us out for a bit, but has never happened. :-)

Open Question: Can I get a mortgage?

In Loom of the Fannie/Freddy Bailout, why doesnt anyone in big media bring up the the fact that most loan officers were instructed to use websites like http://www.FAKEPAYCHECKSTUBS.com (creating documentation that never existed) to help the loan qualify through every step of the pipeline, to collect the 6 percent commission they make on EVERY deal - is it any wonder why the economy and the worlds banking system is where it is at today?

Open Question: What would you do and why??


Ok, say you have 2 small children, have a mortgage and worked at a job with your parent and you pretty much worked side by side all day. Then, unfortunately your parent that you love VERY much passes away. Now your job offers you your parent's position with a pay raise. Now keep in mind that you have 2 kids to support and a mortgage to pay, but the parent you love just passed away and even continuing the job you have done side by side with them would be very hard on you emotionally and everything to do with that job would only remind you of your parent everyday at work or years and years to come.

You have 3 options:
#1 Take your parents position with a pay raise, although it might be emotionally difficult for you for awhile, but will make life better for your family
#2 Pass up the promotion and just contiue the position you already have and be reminded of your parent everyday. But, will keep everything the same for you financially
#3 Take another position offered in another department, but lose out on 10 hours overtime pay, which might cause some financial difficulty for your family, but you wouldn't have to be reminded of your parent everyday

What option would you choose and why??
Do you think that taking option #3 would be selfish? And you have worked with your parent for 8 years.

Open Question: Can I get a mortgage?


Can a first time buyer get a mortgage to buy out siblings who have inherited a house? Would the remaining equity be used as a deposit?

Open Question: Question on using multiple mortgage brokers?

My daughter does not want to live with her dad and everyone knows this. Her dad told the court he would not see her if she lived in cornwall with me as she did for 8.5 yrs she is now 9.5yrs. He is unemployed and receives disabillty and constantly complains of no money. I have to go back to work once my maternity allowance finshes as we cannnot pay the mortgage. I will then not beable to see my daughter as everyone knows how hard it is to get time of work for the school holidays! I have been given 7 weeks. Her dad does not work and could have seen his child 52 weeks of the yr. He also sai he neer wanted to see her. Many people have said he only wants her for the extra benefit. He was a money grabber and still owes me over £1000 from 8 yrs ago. Also we still have not had the judgement.

Open Question: My spouse is going to court for a child support issue?


He has been making the regular payments and trying to get it caught up. He should have had it reduced but it would have cost money he didnt have to go to another state.
We have a certain amount of money to take to court however it is money we really need...like light money and mortgage money. Should we take the money we cannot afford or just go with faith that we have been paying and he has chopped the amount down.

Please serious answers....One of the children is paying for is 20 that needs to be taken off. the question is should we take the light money or have faith that the judge will see he has been paying and trying to chop down the amount. there are many factors that need to be taken in he has other children living in the house hold and his pay has went down

Open Question: Question on using multiple mortgage brokers?


After getting a preapproval, I have signed a loan application with one company and they did all they could and still gave me a no. Then the next day I went to a different mortgage company and they told me yes after two days. I just got a call from the first mortgage broker changing their answer to a yes. What am I obligated too? I signed a loan application with the first mortgage company but they told me no, so I went looking for another option.
